Croton Mother Charged In 6-Year-Old Daughter's Death A No-Show In Court

WHITE PLAINS, N.Y. -- Kathleen Dymes, a Croton-on-Hudson resident, who has been charged in the death of her 6-year-old daughter, Lacey Carr, failed to appear in Westchester County Court for a hearing Tuesday.

Peter Tilem, her attorney, said Dymes is currently hospitalized at NewYork Presbyterian Hospital in White Plains and hospital officials would involuntarily commit her if she tried to sign herself out.

Barbara Zambelli, the judge presiding over the case, demanded that Dymes' doctor, psychiatrist Sandra Lane, appear in court Thursday to explain her absence. Tilem said Dymes would not be able to appear in court.

"We're certainly going to ask her doctor to be there," Tilem said.

Tilem said Dymes is considering taking a plea bargain and Tuesday's hearing was meant to discuss a possible deal. Tilem declined to disclose what the plea deal would contain.

Dymes was charged in September with criminally negligent homicide, endangering the welfare of a child and criminal possession of a controlled substance. Dymes faces up to four years in prison if convicted.

Dymes and Lacey were found by Lacey's father, David Carr on April 5. Dymes and Lacey lived at the home with Dymes' father, Kevin.
