Police Bust Underage Westchester Driver With BAC Double The Legal Limit

A 20-year-old from Port Chester was busted driving with a blood-alcohol content double the legal limit during an early morning stop in Scarsdale over the weekend.

Officers from the Scarsdale Police Department conducting larceny patrol on Sunday morning made contact with James Armand Diaz shortly after 7 a.m., who was sitting with his car idling on Farley Road.

According to police, Diaz told the officers he had pulled over for directions while looking for Walworth Avenue to drop off the 2009 Nissan he was operating. While speaking with him, officers said that they “detected a strong odor of an alcoholic beverage emanating from Diaz’s breath, with glassy and bloodshot eyes.” There was also an empty bottle of vodka and a half-empty bottle of Olde English on the floor of the passenger seat.

Diaz proceeded to fail multiple Standardized Field Sobriety Tests, and an alco-sensor sensor test showed he had a blood alcohol content of .15 percent. At Scarsdale Police Headquarters, a Datamaster DMT test showed his BAC to be .16 percent, double the legal limit. He was also in possession of a Connecticut driver’s license that did not belong to him.

Police arrested Diaz, charging him with driving while intoxicated, operating a motor vehicle with a blood alcohol content greater than .08 percent and aggravated unlicensed operation of a motor vehicle, all misdemeanors. He was later released into the custody of a sober third-party and is due back in Scarsdale Village Court later this year to answer the charge.
