Suspect Shot By Harrison Officer During Arrest

HARRISON, N.Y. – A suspect was shot Wednesday night when police said they tried to arrest him and two others in connection with a Sept. 3 burglary in Harrison.

Daniel DiBiase, 55, of Poughquag, N.Y., was transported to Westchester Medical Center, where he was arrested and charged with taking part in the burglary, according to police. Carmine Stanzione (aka Paul DiBiase), 57, of Poughquag, N.Y., and Jason Foskey, 34, of Stormville, N.Y., were also charged with attempted burglary and burglary in the second degree – both felonies, said police.

The three men had been under surveillance since burglars stole $500,000 worth of jewelry from a Harrison home Sept. 3, according to a Harrison Police Department report.

The men were exiting I-287 eastbound onto Westchester Avenue in Harrison at 6:40 p.m. Wednesday when police said they made a planned stop. Police did not reveal when and why during the arrest two shots were fired, with one striking DiBiase.

The shooting incident is under investigation by the Westchester County Department of Public Safety at the request of the Harrison Police Department.

Stanzione and DiBiase are brothers who “have a history of arrests for burglary and other crimes,” police said in a news release about the arrests.

“The three men are also suspects in numerous home invasion robberies and burglaries in Westchester and elsewhere in the New York metropolitan area,” police added.

Stanzione and Foskey were sent to Westchester County Jail with no bail after being arraigned Thursday in Harrison Town Court. They are due back in court at 9 a.m. Oct. 23. DiBiase was arrested at the hospital and remains there under police guard, police said.
