A wanted Westchester man driving with a blood-alcohol level nearly double the legal limit with a 6-year-old and 9-month old child asleep in the car without safety belts is facing a series of charges after being busted in Westchester during an early morning speeding stop.

While on patrol shortly before 4 a.m. on Monday, June 11, a Scarsdale police officer stopped White Plains resident Javier Galeno Morales, 31, for speeding on Post Road after he drove through a red light at the intersection of Olmsted Road.

During the stop, the officer reported that Morales stated he had several beers in White Plains. While speaking with Morales, the officer stated that he “detected a strong odor of an alcoholic beverage” on his breath, and his eyes were “glassy and bloodshot.”

There was also a 6-year-old sleeping in the backseat with no seatbelt on and a 9-month-old child in the lap of a passenger, Yesenia Elizabeth Hernandez Henriquez, who was not in a car seat.

Police said that Morales went on to fail multiple Standardized Field Sobriety Tests, including a Horizontal Gaze Nystagmus, One "Leg Stand" and the "Walk and Turn," before a breathalyzer determined that he had a blood alcohol content of .14 percent - nearly double the legal limit - at the time of the traffic stop.

After being arrested, a datamaster test at Scarsdale Police Headquarters determined his blood alcohol content was .16 percent, double the legal limit.

Further investigation found that Morales had an active warrant out for his arrest in White Plains for DWAI.

Morales was arrested and charged with a felony count of aggravated driving while intoxicated with a child under the age of 16, and driving while intoxicated, a misdemeanor.

Morales was also charged with two counts of driving with a back seat under the age of 4 without a restraint, moving from a lane unsafely and speeding.

Following arraignment, Morales was remanded to the Westchester County Jail in lieu of $15,000 cash bail or bond.

A Temporary Order of Protection may be issued by a judge, barring Morales from seeing his children, because he was not related to them.

According to police, during the course of the investigation, it was determined that Morales may reside at an address other than what is listed on his identifying documents, and he may currently live in Hawthorne or Thornwood.

The investigation into Morales is ongoing. Keep following Daily Voice for updates as they become available.
